Terms of Service
These terms govern your use of Date Pilot when you install or subscribe to our Shopify application.
1. Agreement
By installing, accessing, or using Date Pilot (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. The Service is provided by Orbitly (“we”, “us”, “our”).
2. The Service
Date Pilot is a Shopify app that lets merchants offer delivery, pickup, or ship date selection on their storefront, manage scheduling rules, view scheduled orders, and related features described on our website and in the Shopify App Store listing.
We may update, improve, or discontinue features at any time. We will make reasonable efforts to avoid breaking core functionality merchants rely on.
3. Eligibility and account
You must be an authorized user of a Shopify store to install Date Pilot. You are responsible for maintaining the security of your Shopify account and for all activity under your store’s use of the Service.
4. Subscriptions and billing
Paid plans, if selected, are billed through Shopify’s app billing system on a recurring basis until cancelled. Fees are non-refundable except where required by law or expressly stated otherwise.
You may change or cancel your plan through the Date Pilot app or Shopify admin. Cancellation stops future charges but does not retroactively refund prior billing periods.
Free plans may include usage limits described in the app or on our pricing page.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or abusive purposes
- Attempt to reverse engineer, scrape, or disrupt the Service
- Interfere with other merchants’ or customers’ use of Shopify
- Misrepresent delivery capabilities to customers in a deceptive way
We may suspend or terminate access if we reasonably believe you have violated these Terms.
6. Merchant responsibilities
You are responsible for:
- Configuring accurate delivery rules, lead times, blackout dates, and capacity limits
- Communicating your delivery and pickup policies to customers
- Fulfilling orders according to dates customers select
- Complying with applicable consumer protection, privacy, and commerce laws
Date Pilot is a scheduling tool. We do not guarantee delivery outcomes or carrier performance.
7. Third-party services
The Service integrates with Shopify and other third-party providers (hosting, email, analytics). Your use of those services is also subject to their terms and policies.
8. Intellectual property
We retain all rights in the Service, including software, branding, and documentation. You receive a limited, non-exclusive, revocable license to use the Service for your Shopify store while these Terms remain in effect.
9. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
We do not warrant that the Service will be uninterrupted, error-free, or compatible with every Shopify theme or third-party checkout customization.
10. Limitation of liability
To the fullest extent permitted by law, Orbitly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service.
Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or one hundred Canadian dollars (CAD $100) if you used a free plan.
11. Termination
You may stop using the Service by uninstalling the app from Shopify. We may terminate or suspend the Service if you breach these Terms or if required for legal or security reasons.
Sections that by nature should survive termination (including limitations of liability and governing law) will survive.
12. Governing law
These Terms are governed by the laws of Canada and the province in which Orbitly operates, without regard to conflict-of-law principles, except where mandatory local consumer laws apply.
13. Changes
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
